Please read these Terms of Service ("Terms") carefully before using the 5,000 Miles platform ("Platform"), operated by 5,000 Miles ("Company," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Platform Overview

5,000 Miles is an online marketplace that connects vehicle owners ("Customers") with independent, self-employed mechanics ("Service Providers") for mobile oil change services. The Platform serves solely as a conduit to facilitate transactions between Customers and Service Providers. 5,000 Miles does not itself perform, supervise, direct, or control any automotive service, repair, or maintenance work.

2. Independent Contractor Relationship

All Service Providers on the Platform are independent contractors and are not employees, agents, joint venturers, or partners of 5,000 Miles. 5,000 Miles does not employ, supervise, direct, or control the manner or method by which any Service Provider performs services. Service Providers are solely responsible for:

  • The quality, safety, and manner of all work performed
  • Providing their own tools, equipment, supplies, and materials (including oil, filters, and any other parts)
  • Maintaining all required business licenses, permits, and registrations
  • Carrying adequate general liability insurance and, where required, workers' compensation insurance
  • Complying with all applicable federal, state, and local laws, regulations, and ordinances
  • Proper disposal of waste oil and materials in accordance with environmental regulations
  • Accurate representation of their qualifications, certifications, and experience
  • Payment of all applicable taxes, including self-employment taxes

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 5,000 MILES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Any damage to your vehicle, engine, drivetrain, or any other component, whether arising from negligence, error, improper workmanship, use of defective parts, or any other cause related to the services performed by a Service Provider
  • Personal injury or property damage arising from or related to the actions, omissions, or negligence of any Service Provider
  • Any environmental damage, including but not limited to oil spills, fluid leaks, or improper waste disposal by a Service Provider
  • Any loss arising from a Service Provider's failure to maintain proper licensing, insurance, or legal compliance
  • Any consequential damages such as loss of vehicle use, rental car costs, towing fees, or diminished vehicle value
  • Any damages resulting from delays, cancellations, or failure to perform services

IN NO EVENT SHALL 5,000 MILES' TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT OF THE PLATFORM FEE PAID BY THE CUSTOMER FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM.

4. Assumption of Risk

By using the Platform and engaging a Service Provider, you acknowledge and agree that:

  • Automotive service inherently involves risk of damage to your vehicle
  • 5,000 Miles has not verified the qualifications, certifications, insurance coverage, or legal compliance of any Service Provider beyond the information provided in their application
  • You assume all risk associated with the services performed by a Service Provider
  • You are responsible for inspecting the completed work and raising any concerns directly with the Service Provider at the time of service
  • Any dispute regarding the quality or outcome of services is between you and the Service Provider

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 5,000 Miles makes no warranty or representation regarding: the quality, safety, or legality of services provided by Service Providers; the qualifications or certifications of Service Providers; the accuracy of any information provided by Service Providers; or the availability of Service Providers in any geographic area.

6. Indemnification

You agree to indemnify, defend, and hold harmless 5,000 Miles, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) any services performed by a Service Provider that you engaged through the Platform; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.

7. Service Availability

5,000 Miles does not guarantee the availability of a Service Provider in any geographic area or within any timeframe. If we are unable to match you with a Service Provider within 48 hours of your request, the request will expire and no charges will be applied. We reserve the right to cancel or decline any request at our sole discretion.

8. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in San Francisco, California. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to a jury trial.

9. Privacy

We collect and store your email address, phone number, vehicle information, and location data solely for the purpose of matching you with a Service Provider and facilitating the service. We may share your contact information and vehicle details with the assigned Service Provider for the purpose of completing the service. We do not sell your personal information to third parties.

10. SMS/Text Messaging Terms

By providing your phone number and checking the SMS consent box during sign-up, you consent to receive automated SMS text messages from 5,000 Miles related to your service requests. These messages may include:

  • Service request confirmations
  • Mechanic assignment and scheduling updates
  • Payment confirmations
  • Mechanic en-route and arrival notifications
  • Job completion notices
  • Oil change reminders based on your estimated driving habits
  • Messages from your assigned mechanic regarding your service

Message frequency: You will receive approximately 5–10 messages per service request, plus periodic oil change reminders (approximately 1–2 per year).

Message and data rates may apply. Your carrier's standard messaging rates apply. 5,000 Miles does not charge for SMS messages.

Opt-out: You can opt out of SMS messages at any time by replying STOP to any message. You will receive a one-time confirmation message. After opting out, you will no longer receive SMS messages from us, though you will still receive email notifications.

Supported carriers: Major US carriers are supported. Carriers are not liable for delayed or undelivered messages.

SMS consent is not required as a condition of purchasing any service. You may choose not to provide your phone number, in which case you will receive service updates via email only.

11. Modification of Terms

5,000 Miles reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any modification constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and 5,000 Miles with respect to the Platform and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and 5,000 Miles.

Privacy Policy

This Privacy Policy describes how 5,000 Miles ("Company," "we," "us," or "our") collects, uses, and shares your personal information when you use our platform ("Platform"). By using the Platform, you agree to the practices described in this policy.

1. Information We Collect

We collect the following categories of personal information:

Information you provide directly:

  • Name and email address
  • Phone number
  • Vehicle information (make, model, year)
  • ZIP code / service location
  • Scheduling preferences
  • Estimated daily driving habits
  • Account credentials (password stored in hashed form only)

Information collected through third-party services:

  • Payment information processed by Stripe (we do not store your full credit card number)

2. How We Use Your Information

We use your personal information to:

  • Create and manage your account
  • Match you with a Service Provider for oil change services
  • Share your contact information and vehicle details with your assigned Service Provider so they can complete the service
  • Process payments through Stripe
  • Send transactional emails (request confirmations, receipts, job completion notices)
  • Send SMS notifications about your service status
  • Send oil change reminders based on your estimated driving habits
  • Respond to your inquiries and provide customer support

3. How We Share Your Information

We share your personal information only in the following circumstances:

  • With Service Providers: We share your name, phone number, vehicle information, and service location with the mechanic assigned to your request so they can perform the service.
  • With payment processors: We use Stripe to process payments. Your payment information is handled directly by Stripe under their privacy policy.
  • With email and SMS providers: We use Resend (email) and Twilio (SMS) to deliver notifications. These providers process your contact information solely to deliver messages on our behalf.
  • As required by law: We may disclose your information if required to do so by law, regulation, or legal process.

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

4. Data Retention

We retain your account information and service history for as long as your account is active or as needed to provide you services. If you request account deletion, we will delete your personal information within 30 days, except where we are required to retain it for legal or regulatory purposes.

5. Data Security

We implement reasonable security measures to protect your personal information, including:

  • Passwords are hashed using bcrypt and never stored in plain text
  • All data is transmitted over HTTPS/TLS encryption
  • Payment information is processed by PCI-compliant Stripe and never touches our servers
  • Database access is restricted to authorized personnel only

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

6. Your Rights

You have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete information
  • Delete your account and associated personal information
  • Opt out of non-essential communications

We use essential cookies for authentication and session management. We do not use third-party advertising or analytics tracking cookies.

The Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected information from a child under 18, we will delete that information promptly.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the updated policy.
